Welcome to YATR.co ("YATR"). By accessing or using our platform, you ("User") agree to be bound by the following Terms and Conditions ("Terms"). These Terms govern your use of YATR's services, website, and any other related features. Please read them carefully before using our services.

If you do not agree with these Terms, you must refrain from using the YATR platform.

By accessing, browsing, or using YATR, you agree to be legally bound by these Terms. If you are booking on behalf of a group, you acknowledge that you have the authority to bind all members of your group to these Terms.

2. Service Description

YATR is an online platform designed to simplify the process of booking yacht charters. While YATR connects Users with yacht providers, we do not own, operate, or control any yachts, captains, or crew. All bookings are subject to the terms and conditions of the yacht provider.

3. User Responsibilities

• Accurate Information: Users must provide accurate and complete information during the booking process.
• Age Requirement: Users must be 18 years or older to book through YATR.
• Compliance: Users must adhere to all applicable laws, regulations, and the terms outlined by the yacht provider.

4. Booking and Payment

Booking Confirmation: Bookings are subject to availability and are confirmed only upon receipt of full payment or a required deposit, as stated during the booking process.

5. Cancellations, Modifications, and Refunds

• Cancellation by User: To cancel or modify a booking, Users must submit a request via the platform by clicking "Request Cancellation" or "Request to Reschedule." Cancellation and modification terms are governed by the yacht provider's policy, which may include penalties or fees.
• Cancellation by Provider: YATR is not liable for cancellations initiated by yacht providers. Users will be notified promptly, and refunds or rescheduling options will be provided in accordance with the provider's policy.
• Force Majeure: YATR is not responsible for cancellations, delays, or modifications caused by events beyond our control, including weather, natural disasters, or government actions.

6. User Conduct

Users must respect the following guidelines:

• No disruptive, unlawful, or inappropriate behavior during bookings or use of the platform.
• No sharing of offensive, fraudulent, or misleading content.
• Users will be held liable for damages caused by them or their guests to the booked yacht.

7. Liability and Disclaimer

• Third-Party Providers: YATR acts as a facilitator and is not responsible for the actions, negligence, or conduct of third-party yacht providers, captains, or crew.
• Platform Use: YATR does not guarantee uninterrupted access to the platform and is not liable for technical issues, outages, or errors.
• Limitations of Liability: YATR's liability, if any, is strictly limited to the amount paid by the User for the booking in question. YATR is not liable for indirect, incidental, or consequential damages.
• Vessel Insurance: YATR does not provide yacht insurance coverage. All vessels listed on the platform are insured by their respective owners. Guests are encouraged to obtain personal travel insurance for additional protection.

8. Intellectual Property

• All content on YATR, including logos, graphics, text, and software, is the exclusive property of YATR or its licensors.
• Users may not copy, distribute, modify, or use YATR's content without prior written consent.

9. Privacy

YATR values your privacy. By using the platform, you consent to the collection, storage, and use of your personal information as outlined in our Privacy Policy.

10. Indemnification

Users agree to indemnify and hold YATR harmless from and against any claims, damages, losses, liabilities, or expenses arising out of:

• Breach of these Terms by the User.
• Misconduct, negligence, or unlawful actions by the User during a booking.
• Violations of third-party rights or applicable laws by the User.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles.

• Arbitration Clause: Any disputes arising from or related to these Terms or your use of the YATR platform will be resolved through binding arbitration, rather than in court. Arbitration will be conducted by a neutral arbitrator in Palm Beach County, Florida.
• Waiver of Class Action: Users agree to resolve disputes on an individual basis and waive the right to participate in class actions.

12. Modifications to Terms

YATR reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on the platform. Continued use of the platform after changes constitutes acceptance of the updated Terms.

13. Termination

YATR reserves the right to terminate or suspend User access to the platform for violations of these Terms or other reasons deemed necessary by YATR.
